1. Acceptance of Terms
These Terms of Service (the "Terms") constitute a legally binding agreement between YOMI FILM LLC ("Provider", "we") and any person ("User", "you") who accesses or uses the website yomimovie.com and its subdomains, including scriptrp.yomimovie.com (the "Service").
By accessing or using the Service (including by registering an account, browsing the Site, or purchasing a subscription) you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must stop using the Service.
2. Definitions
- Service — all software and information resources hosted on the Site and its subdomains that provide functionality to Users (including creating and storing scripts).
- Account — the set of data identifying a User within the Service.
- Subscription — the right to use paid Service functionality for a paid period.
- User content — any materials (scripts, texts, files) uploaded, created, or stored by a User within the Service.
3. Registration & account
3.1. To use extended functionality, you must create an Account by providing an email address and password. You may also provide a name or pseudonym.
3.2. You must provide accurate information and keep it up to date.
3.3. You are responsible for keeping your password secure and for all activity under your Account. Notify us immediately of any unauthorized access.
3.4. You must have reached the minimum age required to enter into an agreement under the law applicable to you. Minors may use the Service only with the consent of their legal representatives.
4. Description of the Service
The Service provides tools for creating, editing, storing, and sharing scripts and other creative content related to the film industry. The Service may include both free and paid functionality.
We may change, add, or discontinue features at any time, with notice to Users through the Site or by email where appropriate.
5. User rights and obligations
5.1. You may:
- use the Service within the scope of your plan;
- create, edit, and delete your User content;
- delete your Account at any time;
- contact our support team.
5.2. You agree to:
- comply with these Terms and our other documents;
- comply with applicable law;
- respect the rights of third parties, including intellectual property rights;
- not use the Service for unlawful purposes.
6. Provider rights and obligations
6.1. We may:
- modify these Terms, pricing, and Service functionality;
- suspend or terminate access in case of breach;
- perform maintenance that may temporarily affect Service availability;
- remove User content that violates these Terms or applicable law.
6.2. We will:
- take reasonable measures to maintain the Service;
- protect your data in accordance with the Privacy Policy and Personal Data Processing Notice.
7. Intellectual property
7.1. User content. All intellectual property rights in User content (including scripts, texts, and other creative materials you create or upload) remain entirely with you. Nothing in these Terms transfers ownership of your User content to us.
7.2. Limited license to the Provider. Solely for the technical operation of the Service (storage, backups, transmission over networks, display of content to you and to third parties to whom you yourself grant access), you grant us a non-exclusive, royalty-free, worldwide license to use your User content. The license applies only while the content is hosted on the Service and terminates when the content or your Account is deleted.
7.3. Our rights. All rights in the Service itself — the Site, source code, design, trademarks, logos, and other identifiers — belong to us and/or our licensors. You may not use them without our prior written consent.
8. User content
8.1. You are solely responsible for the User content you upload or create, including its compliance with applicable law and third-party rights.
8.2. By posting User content, you confirm that you have all necessary rights to do so.
8.3. We do not pre-moderate User content but may remove or restrict access to content that violates these Terms or applicable law, either upon a reasoned complaint or on our own initiative.
9. Prohibited conduct
You may not:
- upload or distribute unlawful content, including extremist materials, incitement to violence, child sexual abuse material, or content that offends human dignity or promotes hatred;
- infringe third-party intellectual property rights;
- upload malware;
- interfere with the operation of the Service, its features, servers, or networks;
- use the Service to send spam or unsolicited marketing;
- attempt to gain unauthorized access to the Service, other Users' accounts, or underlying infrastructure;
- transfer access to your Account to third parties for compensation without our consent.
10. Paid services and subscription
10.1. Certain features are available on a paid basis via Subscription. The scope of paid functionality, pricing, and Subscription duration are specified on the relevant pages of the Site.
10.2. Payments are processed via third-party payment providers. Payment is considered complete when funds are received by us or our payment agent.
10.3. Subscriptions may be set to auto-renew. In that case, you authorize recurring charges to the payment method used at sign-up. You may disable auto-renewal at any time in your Account settings.
10.4. If payment is not received on time, we may suspend or limit access to paid functionality.
11. Refunds
11.1. You may request a refund for the unused portion of your Subscription as permitted by applicable law, including consumer protection laws.
11.2. Refund requests should be sent to privacy@yomimovie.com.
11.3. Refunds are issued using the same payment method within 10 business days from approval of the refund request.
12. Disclaimers and liability
12.1. The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, suitability for your specific purposes, or freedom from errors.
12.2. We are not responsible for User content or for any consequences of its use by third parties to whom you grant access.
12.3. To the maximum extent permitted by law, our aggregate liability for any claims relating to the Service is limited to the amount you actually paid to us during the 12 months preceding the event giving rise to the claim.
12.4. Nothing in these Terms limits our liability where such limitation is prohibited by applicable law.
13. Suspension and termination
13.1. We may suspend or terminate your access to the Service if:
- you breach these Terms;
- we receive reasoned complaints from third parties or demands from authorities;
- you fail to pay for paid functionality.
13.2. You may stop using the Service and delete your Account at any time through the relevant functionality of the Site or by contacting support.
14. Changes to the Terms
We may update these Terms from time to time. The updated version takes effect upon publication on the Site, unless a later effective date is specified. Continued use of the Service after changes take effect constitutes your acceptance. If you disagree with the changes, you must stop using the Service.
15. Governing law and disputes
15.1. These Terms are governed by the laws of the Russian Federation.
15.2. The parties will attempt to resolve disputes through negotiation. A written claim must first be sent to privacy@yomimovie.com or to the address above; the other party has 30 days to respond.
15.3. If no resolution is reached, disputes will be submitted to the courts at the Provider's location, unless mandatory rules of applicable consumer protection law provide otherwise.
